As one who frequently makes public records request, as has litigated a few, I agree with Hardin that those of us on the other end of the political spectrum from his free market organization should be paying close attention.
One problem I have recently come across is that the Legislature considers Legislative Counsel to be their legal firm and that communication between legislators and the counsel are exempt. This is one of those interpretations where the exemption swallows the rule. It assumes that advise as to the wording or effect of potential legislation is on the same footing as advice to a client whose property, privacy, or liberty interests are the subject of the legal advice.
We should all pay close attention to the EELI case. It certainly will have a wide effect on the scope of the exemptions to Vermont's Public Records Act.
Let's see the evidence that: 1. The malware was targeted at Burlington Electric, rather than one of those viri we pick up whenever we do something stupid on the Internet; 2. That it came from the Russian gov't, as opposed to criminal elements, organized or not, in Russia or elsewhere.
