Professor Robinson should read the MacDonald case which while it ruled against cutting trees for the 1930's Winter Olympics nonetheless used timber defined as 3 inches diameter breast height. Bulsom Anglers a 3rd Department Case used the same standard of 3dbh. . The court established a new standard for "timber" and that is what was surprising in this decision.
On the other hand the court ruled that snowmobile trails did not violate the "forever wild" clause.
