The Executive Order of 1/25/17, specifically seeks only to confirm those laws which currently exist and with great specificity recognizes that any agreement is subject to the consent of State and local officials. Clearly the administration does not seek to compel the State of Vermont to perform the duties of the Federal agencies; it merely confirms the Federal Governments authorization for those entities to assist if they should choose to do so.

Nothing in either of the Executive Orders relating to refugees, immigrants or border security should have lead Governor Scott to declare "Vermont will continue to uphold the laws of our state and nation, but we will not be forced to take any action that we believe violates Constitutional rights, or infringes upon the rights of Vermont as a sovereign state."

It appears that Governor Scott has been swept into the media hysteria surrounding President Trumps executive orders relating to immigration and refugees from certain Middle Eastern and North African nations which had been identified by the Obama administration as worthy of a heightened concern to our nation those countries include: Iran, Iraq, Libya, Sudan, Syria and Yemen.

A fair reading of the Executive Order reveals nothing that would interfere with any of the immigrants or refugees who are currently residing in Vermont, regardless of their citizenship status. Additionally, nothing in the order imposes any prohibition, restriction or requirement on any state, county or local official. The order exclusively relates to the activities of officials in Homeland Security, the Office of the U.S. Secretary of State, the NSA and the FBI; relating exclusively to the vetting and clearance of refugees from the above mentioned countries.

Interestingly, little attention has been given to the Executive Order of January 25, BORDER SECURITY AND IMMIGRATION ENFORCEMENT IMPROVEMENTS which does, in its section #10, discusses: (a) engaging with the Governors of the States, as well as local officials for the purpose of preparing agreements (b) To the extent permitted by law and with the consent of State and local officials to authorize State and local law enforcement officials . . . to perform the functions of immigration officers in relationship to the investigation, apprehension or detention of aliens in the United States Such authorization shall be in addition to, rather than in place of, Federal performance of these duties.

Hopefully Historic Sites will be moved from Commerce to BGS, a more appropriate fit as the State House, the Pavilion and other important state buildings are currently under their supervision. Historic Sites has always been treated like the orphan child over at Commerce - under-funded, under-staffed and generally neglected !

Sadly, the Republican bench is pretty thin and it seems like Turner's criticism comes awfully late in the game. That being said, it is beyond belief that Phil Scott has chosen Al Gobeille to head up anything, let alone the largest department in Vermont State government with a budget of over $3,616,179,557.00 (2016). I guess the Vermont Health Connect fiasco wasn't enough to demonstrate that Al's restaurant management skills didn't translate well to the governmental environment. Vermont will see little change with the same crew in charge that got the state into this mess in the first place.
