I've been in the construction industry most of my life and this issue is simply a way for a contractor who lacks the ability to provide good service, quality work, and proper management so they choose to compete against the honest business owner by illegally reducing his labor cost and avoiding municipal, State, and Federal regulations. The instant you misclassify your employees as independent contractors the employer saves a minimum of 23% of his labor cost by avoiding workers comp and other employment taxes. His former employees who he now calls "independent contractors" no longer are subject to prevailing wage, overtime pay, unemployment insurance, safety regulations to name just some of the consequences. It also sends a signal to everyone that the only way to succeed is to engage in illegal activity.

This type of predatory business owner pulls the rug from under honest business owners who are operating legally and ethically. The actions of criminal employers will eventually force the honest business owner out of business and force the honest employers employees onto the streets. Those employers that misclassify their employees are criminals engaged in white collar crime.
