Notice is hereby given of changes to the Burlington Code of Ordinances, Chapter 26, Wastewater, Stormwater, and Pollution Control.

Statement of purpose

The purpose of the amendments are as follows:

• Authority to establish interim local limits for pollutants of concern

• Increased clarity regarding the City’s ability to charge a surcharge fee to high strength users for organic loading as a condition of allow discharges beyond the prohibited limits in 26-71(d)

• Authority to adopt regulations that would guide the administration and fees for a local wastewater connection permitting program that would satisfy the State wastewater permitting requirements currently administered by the State

• Authority to adopt regulations and fees related to a local industrial pollution prevention (“pretreatment”) program that would bring Burlington’s industrial users into compliance with Federal and State pretreatment statutes

The amendments apply to the entire City of Burlington.

The amendments modifies the following sections of the Burlington Code of Ordinances:

• Chapter 26, Wastewater, Stormwater, and Pollution Control; Division 4, Use of Public Sewers; Sections 26-71, Use of public sewers generally and 26-76, Wastewater permit fees are modified.

• A new Division 5, Pretreatment Requirements, is added including Sections: 26-77 Effective Date and Interim Regulations; 26-78, Purpose and Policy; 26-29, Definitions; 26-80, Prohibited Discharges; 26-81, Permits Required; 26-82, Regulations; 26-83, Violations; 26-84, Fees.
