NOTICE OF APPEAL
Appellant Allen Brook Development Incorporated (“Allen Brook”), by its attorneys, Gravel & Shea PC, pursuant to V.R.E.C.P. 5, and Act 250 Rule 31(A)(3), hereby appeal to the Vermont Superior Court, Environmental Division the Judgment, including without limitation, the July 8, 2026 Memorandum and Decision and Order on Motion to Alter by the District #4 Environmental Commission, and the underlying April 7, 2026 Findings of Fact, Conclusions of Law, and Order (together, the “Decision”) denying an application for a 5-lot commercial subdivision on an existing irregularly shaped 109.5-acre lot (previously designated as Parcel B) within the existing Saxon Hill Industrial Park in Essex, Vermont, along with the proposed construction of a roadway, supporting infrastructure and a 33,600 square foot warehouse on one of the newly-created lots (the “Project”). As the applicant, Allen Brook has party status under 10 V.S.A. § 6085(c)(1)(A) and may appeal the Decision to the Environmental Division under 10 V.S.A. § 8504(a). Pursuant to the above-cited statutes, Allen Brook has standing to file this appeal.
