Construction of a railroad salt depot in Shelburne can continue — for now —after a hearing in federal court Monday.
U.S. District Court Judge William K. Sessions III did not immediately halt the project, and Vermont Railway vowed to proceed with the rail facility off U.S. 7 near the LaPlatte River.
The town of Shelburne has sued to block the project and Monday sought a preliminary injunction to stop all work while the suit is pending.
Although Sessions allowed work to continue, he ordered a full evidentiary hearing on the matter to be scheduled by the end of April, according to a one-paragraph summary of the proceedings filed on the court docket Tuesday.
He indicated there would be scrutiny of Vermont Railway’s bid to construct the facility under a federal preemption, which would bypass local and state Act 250 environmental review.
Both sides claimed a win in the heated battle over the relocation of the railway’s salt and trucking facility from Burlington to Shelburne.
“Yesterday was a large victory for the town of Shelburne,” Shelburne Selectboard Chair Gary von Stange told Seven Days Tuesday. “Yesterday validated the town’s position that Vermont Railway’s unilateral assertion of preemption was premature.”
The Railway also celebrated. “We are pleased that the Court recognized the importance of moving forward,” said David Wulfson, president of Vermont Railway, in a press release titled: “Federal Court Rejects Effort to Delay Vermont Railway Project in Shelburne.”
The town fired back that Vermont Railway was suggesting that the injunction was denied, saying that suggestion was false. In a press release, von Stange accused the Railway of “continued myopic grandiosity” and a public relations campaign that “has been and continues to be disingenuous.”
In response, Vermont Railway deputy counsel Peter Young underscored the fact that Shelburne’s legal team left court without an injunction. “The court did not issue any order that would delay or halt construction. We are pleased with the outcome and remain confident of success,” Young stated.
Young said Vermont Railway is proceeding with construction in Shelburne and has no plans to stop. “We see this as a big win,” he said.
Meanwhile, von Stange declined to say whether Shelburne would try another tactic to immediately halt the project while the lawsuit is pending. “I’m going to reserve comment, as that entails legal strategy.”
In related news Monday, the Burlington City Council unanimously approved a zoning change at the site where Vermont Railway now stores salt. City Market plans to purchase the property located at Flynn Avenue and Briggs Street. The zoning change will allow the market to pursue permits in the South End for a second store.
The railway began extensive tree cutting on the Shelburne site in December and halted work in late January on the orders of the state Department of Environmental Conservation. The Department subsequently issued a stormwater construction permit February 24, allowing site work and construction to resume.
The town of Shelburne has vowed to fight the project on multiple legal fronts and has even negotiated with the railway for the possible purchase of the site, but that effort appears to be stalled. Wulfson has told the town he would need at least $6.5 million to buy and prepare another site.




The City Market proposal is to only build on the small northern portion of the site, where the current salt sheds don’t exist, anyway. The salt sheds could stay where they are with no conflict.
And the salt sheds should logically stay where they are, as the Champlain Parkway is finally slated to begin construction and has passed through all legal hurdles. The proposed parkway is directly adjacent to this property, and will give VT Rail and Barrett Trucking a direct connection to I-189, which they have always lobbied for.
Moving this facility to a place far from I-89 in Shelburne, on a parcel that is incredibly environmentally sensitive which borders the LaPlatte River on one side and important wetlands on the other, and is an unsafe area area for truck traffic due to it’s location on a dangerous hill/curve, makes absolutely no sense.
Burlington and City Market are on-record as wanting to build intensive housing on the current VT Rail site. This is the crux of the problem. Burlington is also trying to acquire another section of VT Rail’s property to create a road spur to Battery Street. This is all about greed, money, lies, and politics…and little else.
I hope the Discovery Phase of this litigation brings the real issues to light.
